The child must have a disability as defined under IDEA (13 categories: e.g., autism, specific learning disability, emotional disturbance, etc.)
 

The child must need specially designed instruction (i.e., special education) as a result of that disability, meaning the child cannot receive appropriate educational benefit without it.
